Official IMSE Foundation Scholarship Rules

NO PURCHASE NECESSARY TO ENTER OR RECEIVE AN IMSE FOUNDATION SCHOLARSHIP. A PURCHASE DOES NOT IMPROVE YOUR CHANCES. VOID WHERE PROHIBITED BY LAW

1. BINDING RULES. Sponsor will conduct the Scholarship offering substantially as described in these Official Scholarship Rules (the “Rules”). Your submission of an entry in the Scholarship constitutes your agreement to be bound by these Rules, as interpreted by the Sponsor in its sole discretion. A failure to comply with these Rules will disqualify your participation in the Scholarship and void any entries submitted by you. This scholarship is void where prohibited by law.

2. PRIZES. A description of each scholarship (“Scholarship”) and its approximate retail value (“ARV”) is attached to and made a part of these Rules. Such information is also available on Sponsor’s website at IMSE Foundation. The depiction of the Scholarships in any advertising or promotional materials may not reflect the actual Scholarships delivered to the recipients. All Scholarships are awarded on an “as is” basis without any representations or warranties other than those expressly set forth herein. Sponsor may, at its discretion, substitute a Scholarship of equal or greater value.

3. SPONSOR. IMSE Foundation, Attn: Teresa Garretson, 19408 Malvern Ct., Northville, MI 48167, is the sponsor of these scholarships (“Sponsor”).

4. ELIGIBILITY. Only individuals who are 21 years of age or older and who are legal residents of the United States of America and the District of Columbia, but excluding Florida, New York, Rhode Island, and Washington, and also excluding Puerto Rico and other U.S. territories, are eligible to participate in these Scholarship offering. Canadian residents are not eligible to participate. Also excluded from eligibility are any employees, directors, trustees, and officers of the Sponsor and their immediate family members (spouse, parents, siblings, and children) and/or those living in the same household of such individuals. No purchase necessary to participate.

5. ONLINE ENTRY. To participate in the scholarship online, please go to the Sponsor’s website and provide the information requested. The sponsor is not responsible for technical malfunctions or human error of any kind when processing scholarship entries.

6. MAIL-IN ENTRY. As an alternative to participation online, you may participate in the Scholarship by submitting a mail-in entry. No purchase is necessary. To submit a mail-in entry, please follow these instructions. In your own handwriting, submit the following information on an ordinary index card:

● your full name,
● home address,
● home telephone number with area code,
● email address, and
● the name of the Scholarship

and mail it in a stamped, hand-printed envelope mailed first-class to:

Limit one (1) entry per person. Any entries which are incomplete or illegible shall be deemed void and ineligible. Sponsor shall be deemed the owner of all entries and shall have no obligation to verify receipt of, or to return, any entries. Entries may be submitted either online or via mail-in entry, but not both. Entries submitted both online and via mail-in entry will be disqualified.

7. RULES OF PARTICIPATION. All Scholarship recipients must agree to share their experience of IMSE training and, if requested, be willing to share their story on the IMSE Foundation website, marketing materials, and social media.

8. WARNING AGAINST TAMPERING. ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH, OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL MEDIA SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SCHOLARSHIP, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSOR RESERVES THE RIGHT THE SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO VOID ANY AND ALL ENTRIES OF ANY ENTRANT WHO SPONSOR BELIEVES HAS ATTEMPTED TO TAMPER WITH OR IMPAIR THE ADMINISTRATION, SECURITY, FAIRNESS, OR PROPER PLAY OF THESE SCHOLARSHIP. IN ADDITION, IF THE SPONSOR DETERMINES, IN ITS SOLE DISCRETION, THAT THE INTEGRITY AND SECURITY OF THESE SCHOLARSHIPS HAVE BEEN COMPROMISED, THE SPONSOR MAY SUSPEND OR CANCEL THESE SCHOLARSHIPS OR MODIFY THE RULES AS IT DEEMS FAIR AND APPROPRIATE UNDER THE CIRCUMSTANCES.

9. ENTRY PERIOD. The entry period for these Scholarships is available on the Sponsor’s website at IMSE Foundation. Each Scholarship may commence and end on a different date and time. Entries received by the Sponsor outside of the entry period are void. No purchase is necessary to enter or win.

10. SELECTION AND AWARD. The potential recipient(s) of the Scholarship will be selected at the first regularly scheduled meeting of the IMSE Foundation Board of Directors following the close of the entry period. A list of these potential recipients may be published on IMSE Foundation. The recipient will be awarded one (1) Scholarship for each scholarship offering. A potential recipient will be deemed to have forfeited a Scholarship if the recipient (a) fails to comply with these Rules, (b) is determined to be ineligible by Sponsor, (c) declines to accept the Scholarship, or (d) cannot be contacted by Sponsor after Sponsor’s reasonable efforts and attempts to do so. In any such case, the Sponsor may, in its discretion, award the Scholarship to an alternate entrant. To qualify as an official recipient and to receive the Scholarship, a potential recipient is required to timely submit to the Sponsor all such forms, documents, and information as Sponsor may require, including without limitation confirmation of eligibility, appropriate releases, and pertinent tax documentation. Official recipients will receive written confirmation of the award and be advised on the process for claiming the Scholarship.

11. ODDS OF RECEIVING. Your odds of receiving the Scholarship will depend on the number of eligible entries received by the Sponsor. No purchase is necessary to win.

12. RECIPIENT’S LIST. A list of the official recipients can be obtained by sending a self-addressed stamped envelope to IMSE Foundation 2024 Scholarship – Recipients List, IMSE Foundation, Attn: Teresa Garretson, 19408 Malvern Ct., Northville, MI 48167. Return postage is not required of Vermont residents.

13. TAXES AND EXPENSES. Except as expressly provided in the Scholarship description, all taxes, fees, costs, and expenses associated with the receipt and use of any Scholarship shall be the sole responsibility of the recipients. Such expenses may include travel and transportation costs. Recipients may be issued an IRS Form 1099 or other comparable tax record.

14. TRANSFERABILITY OF SCHOLARSHIPS. Scholarships are not transferable. Scholarships are not redeemable for cash.

15. DISCLAIMER. Sponsor disclaims all liability arising out of or relating to technological or communications errors, failures, or malfunctions associated with the conduct and operation of the Scholarship.

16. FORCE MAJEURE. Sponsor shall not be liable or responsible for any failure or delay in fulfilling or performing any term of these Scholarships when and to the extent such failure or delay is caused by or results from acts or circumstances beyond the control of Sponsor and Sponsor’s obligations hereunder shall be suspended during periods in which there exists a force majeure event. A force majeure event is hereby defined as any event beyond the control of the Sponsor, including, without limitation, acts of God, natural catastrophes, fire, flood, hurricanes, tornados, volcanic activity, earthquakes, explosions, governmental actions, war, invasion or hostilities (whether war is declared or not), insurrections, terrorist threats or acts, riots, or other civil unrest, labor strikes, quarantines, national emergency, epidemics, and viral pandemics. If any such force majeure event shall continue for a period of more than sixty (60) days, the Sponsor may, in its sole and absolute discretion, terminate this scholarship without liability to you or any other person participating in the Scholarship.

17. RELEASE AND COVENANT NOT TO SUE. BY PARTICIPATING IN THESE SCHOLARSHIPS, YOU HEREBY AGREE TO FOREVER RELEASE THE RELEASED PARTIES (AS DEFINED BELOW) FROM AND COVENANT NOT TO SUE THE RELEASED PARTIES FOR ANY AND ALL LIABILITY, CLAIMS, CAUSES OF ACTION, LOSSES, OR DAMAGES, INCLUDING COSTS AND ATTORNEYS’ FEES, ARISING OUT OF OR RELATING IN ANY WAY TO YOUR PARTICIPATION IN THESE SCHOLARSHIPS OR FROM THE ACCEPTANCE OR USE OF THE SCHOLARSHIP. FOR PURPOSES OF THESE RULES, THE “RELEASED PARTIES” SHALL MEAN THE SPONSOR AND ITS DIRECTORS, TRUSTEES, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS. YOU HEREBY FURTHER AGREE THAT YOU WILL NOT SEEK TO OBTAIN AND WAIVE ALL RIGHTS TO ANY SPECIAL, PUNITIVE, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL OR ANY OTHER DAMAGES (OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES) FROM THE RELEASED PARTIES. THIS RELEASE AND COVENANT NOT TO SUE SHALL BE CONSTRUED BROADLY AND LIBERALLY IN FAVOR OF AND FOR THE PROTECTION OF THE RELEASED PARTIES.

18. LICENSE. By participating in these Scholarships, you hereby grant to Sponsor and its licensees a perpetual, worldwide, royalty-free license to use your name, address, photograph or other likeness, voice, statements, or any other personally identifiable information for any and all marketing, promotional, or other legitimate business purposes. Subject to the foregoing and applicable law, all personal information collected by the Sponsor in connection with these Scholarships will be subject to the Sponsor’s Privacy Policy, which is hereby incorporated by reference into these Rules. A copy of this Privacy Policy may be found at IMSE Foundation. 

19. GOVERNING LAW. Any disputes relating to these Scholarships or these Rules shall be governed by and construed in accordance with the laws of the State of Michigan without regard to conflicts of law principles. Your participation in these Scholarships shall be deemed as giving consent to the jurisdiction and venue of the federal and state courts located in Michigan.
